Keith v. Tops Restaurant
In this matter, Jean Keith went to Tops Restaurant and ordered a club sandwich. The club sandwich was divided into four squares and held together by toothpicks. Ms. Keith removed all of the toothpicks and ate the sandwich. After eating the sandwich, she felt discomfort in her stomach. The discomfort turned into pain and progressively got worse throughout the following week. She eventually went to the hospital with severe abdominal pain. An emergency exploratory surgery was performed on her abdominal cavity. The surgeon found a piece of broken off toothpick that had perforated Ms. Keith ‘s small intestine. She developed a severe infection. She later developed 7 incisional hernias which had to be surgically repaired. Tops Restaurant was sued for product liability and breach of implied warranty of merchantability.
Verdict: At trial, Mr. Mabile obtained a jury verdict in the sum of $103,000.00.
Partnership Lawsuit
Seymour v. Harris
This case involved a partnership dispute. The partnership owned a storage facility located in Alpine, CA. Defendant Harris represented to his two partners that the bank who held the trust deed on the property was going to foreclose due to lack of making timely payments on the mortgage. He represented that the bank would only agree to refinance the property if he became the sole owner of the property. In exchange for transferring their interest in the storage facility, the defendant agreed to provide his two partners with promissory notes in the sum of $17,000.00 each to be made payable in 5 years. When the promissory notes became payable, the defendant refused to honor them claiming that he was placed under economic duress and was forced to sign the notes otherwise the bank would take over the property. The defendant stated that he had no intent to pay the two promissory notes at the time he signed them.
Verdict: At trial, the jury found for the plaintiffs and awarded $615,000 in compensatory damages and $125,000 in punitive damages.
MOTORCYCLE Lawsuit
Sanchez v. Johnson
Mr. Sanchez was riding his motorcycle east on Miramar Road. Mr. Johnson was driving his car north on Kearny Villa Road. He was late for work. Traffic was backed up at the light facing him. Instead of waiting for traffic to clear, he maneuvered his car over to the bike path lane, came to the limit line and stopped. While facing a red light, he proceeded into the intersection. Mr. Johnson’s car ran into the motorcycle Mr. Sanchez was riding instantly killing him.
Verdict: Mr. Mabile obtained a judgment against Mr. Johnson in the sum of $903,000.00.
Slip and Fall Lawsuit
Edwards v. First Assembly of God
Ms. Edwards attended a faith healing service at First Assembly of God church. The faith healing service was run by Rob Stark who ran the ministry called Miracle Monday. This service practices the physical act of “Laying on of Hands” where the head is touched by the minister. After “hands are laid” the attendee falls backwards or down to the ground as they are said to have been “slain in the holy spirit”. Hands were laid on Edwards. She fell backwards and struck her head on a wall. People who are “slain in the spirit” are to be caught by designated catchers. No one attempted to catch Edwards as she fell backwards. Edwards suffered two disk herniations in her neck which required surgery.
Verdict: The matter was settled for the sum of $300,000.
